A 28-year-old patient went to his urologist to test his penis for genital warts. The urologist was supposed to apply acetic acid (vinegar) to the skin on the patient's penis in order to whiten and identify the warts. Instead of getting the acetic acid, the urologist's nurse brought him a bottle of trichloroacetic acid, which is used for chemical peels, tattoo removal, and the removal of warts. It works by burning off skin cells. The urologist never checked the acid before applying it to the patient's penis. As a result, the patient's penis was severely burned. The patient claimed disfigurement and some loss of sexual function. After a 5-day trial, the Shelby County jury awarded the patient $1,000,000. There was no appeal. Todd v.
