Plastic Surgeon Suffers Cervical Injury From Rear-End Collision

A 57-year-old plastic surgeon was rear-ended by the De- fendant's SUV while waiting in a line of traffic on Harding Road. The Plaintiff had pre-existing arthritis in his neck and shoul-der; however, the collision caused nerve damage in the cervical area which resulted in atrophy of the deltoid and bicep muscles. He suffered a decline of approximately 50% in his ability to perform his surgical procedures. The Plaintiff experienced a significant loss of income.

Dr. Emanuel Weiss, his neurosurgeon, performed a cervi- cal laminectomy. The Plaintiff was out of work for recovery for approximately one month. His orthopaedic surgeon, Dr. Robert Snyder, who had treated him for his pre-existing arthritis and for the nerve damage he sustained as a result of the collision, and Dr. Weiss, both opined that Dr. Sanders had sustained 75% of his permanent impairment as a result of the automobile wreck.

Dr. Bruce Shack served as Plaintiff's expert in Plastic Surgery, testifying as to the physical exertion and dexterity needed to perform most plastic surgeries and the average work-life of plastic surgeons in the Nashville community. Dr. Tyler Kress served as the Plaintiff's biomechanical expert, testifying about the force of the collision and the effect it had on the physician's body. Dr. Gilbert Mathis served as the Plaintiff's economist.

The case was settled for $975,000 five days before trial.
